PROCOUNTRY AUCTION SERVICES USER AGREEMENT

This agreement describes the terms and conditions that apply to the bidding or buying of items offered by ProCountry, LLC. You must register and accept the terms of this agreement to use our services.  By registering, you agree that you have read and understand the terms and conditions and you are bound by this agreement. ProCountry, LLC reserves the right to change or modify this agreement at any time and at its sole discretion. Changes will be effective upon posting and may be posted without notice to you. Your continued use of these services following the posting of changes will establish your acceptance of the changes or modifications. If you do not agree to these terms, do not register, or continue to use this site or services.

Buyer Responsibility:

You must be at least 18 years to register and place bids on any items. You may not register and make bids under a false name or with false account information. Fraudulent conduct is a violation of federal and state laws. To participate we may require a valid credit card number, billing address, phone number, email address, and credit card expiration date. Credit card information is only used as a form of identification. Your credit card number is not disclosed to any unauthorized third-party. You are giving ProCountry, LLC permission to send marketing emails to the email address on the account.

You may not disclose your password to any third party and are responsible for any use or action taken under your password on this site. If your password is compromised or disclosed, you must change your password. You are solely responsible for maintaining the security of your personal information.

By bidding, you are making an offer for the purchase of the item. If you are the winning bidder, you are legally obliged to complete the transaction. You cannot retract a bid unless there are unique circumstances or obvious typographical errors. ProCountry, LLC reserves the right to reject any and all bids for any reason.

No Warranties:

ProCountry, LLC has generally described and photographed each item.  However, ProCountry, LLC has not operated, tested or conducted an in-depth inspection of the items included in this auction.   Bidders are encouraged to fully examine all items before bidding.  While descriptions are believed to be correct and information was obtained from sources deemed reliable, any information contained in the item’s descriptions is in no way a guarantee or warranty expressed or implied.  Each item in the auction is being sold “AS IS WHERE IS”, without warranty or guarantee of any kind, including merchantability or fitness for a particular purpose.  Hours & Odometer readings published are not guaranteed.  You are responsible for your own inspection during inspection periods.

Payment Terms:

All sales are final. A bid is a legal binding contract. Accounts must be settled for by the end of the scheduled pick up. All Fees are quoted in US Dollars. Final purchase price will include sales tax, buyer’s fee, and purchase price. Payment must be made with cash, cashier’s check, money order, credit/debit card (UP TO $500 TOTAL PURCHASE) or wired funds. There is a 4% administration fee for credit/debit card purchases. NO PERSONAL OR BUSINESS CHECKS ACCEPTED WITHOUT PRIOR APPROVAL.  Removal of sales tax requires a completed state sales tax exemption form. Buyer’s fee is taxable if the item is taxable.

Conditions:

Auctions may have an auto extend feature. The bidding will extend for a set time increment from the time the last bid is placed until there are no more bids and the lot has sat idle for that time increment.

Shipping:

Call to check availability for shipping before bidding as it is not always possible. All items are sold assuming the buyer will pick up their item(s) at the auction location. If you choose to have your items shipped, this is an extra service. Items must be paid for before shipping is available. WE DO NOT SHIP FOR FREE. Shipping is a separate charge, paid after your items are packaged. The total shipping charge is the sum of the cost of materials, the carrier’s rate, and our time. The lowest possible carrier rate is chosen whenever possible.

Disputes:

The laws of the United States and the State of Wisconsin will govern this agreement. Any action or settling of disputes must be brought in the federal or state courts located in Buffalo County Wisconsin.

ProCountry, LLC is the agent or representative of the seller/owner only.

Disclaimers:

You hereby release, hold harmless and protect ProCountry, LLC ( and their respective employees and collectively “ProCountry’s Providers”) against all claims, actions, liabilities, damages, penalties, or expenses incurred by ProCountry, LLC relating to (1) breach of any term, condition, or representation of this Agreement; (2) improper or illegal use of these services (3) ProCountry, LLC  shall not be held responsible for a missed bid or the failure of the Software or the Software Application not to function properly for any reason.  You acknowledge that the Software and the Application may not be operational at any given time for assorted reasons, including repairs, maintenance, upgrades to the application, and many causes that are not within the control of ProCountry, LLC, including without limitation power failures, defects in third-party equipment, and acts of God. If the Software or the Application fails to properly operate for any reason during any auction, thus preventing you from receiving a bid, you acknowledge and agree that you are subject to the limitation of liabilities set forth within these Terms of Use.

You acknowledge that the Software Application cannot function without internet service. ProCountry, LLC is not liable to you or any bidder if bids cannot be sent or received due to the lack of or loss of internet service at the locations where the bids are being sent or received

You represent and warrant that you are at least eighteen (18) years of age; you possess the legal right and ability to enter into this agreement; you will use the services only for lawful purposes and in accordance with this agreement; and you will be financially responsible for your account and all transactions you enter into through the use of this site.
